Electronic Smoking Device Retailer Registration

Pursuant to Act 206, Session Laws of Hawai‘i 2018, as of July 1, 2018, an entity that engages in the retail sale of electronic smoking devices must register with the Electronic Smoking Device Retailer Registration Unit (Unit) of the Hawai‘i Department of the Attorney General.

In enacting Act 206, the Legislature determined that registration of electronic smoking device retailers is necessary to protect the health, safety or welfare of consumers of electronic smoking devices.  Failure to timely register may subject violators to a civil penalty of $100 for each day the violation occurs, plus the costs of any investigation conducted by the Unit. 

Retailers must register immediately, starting November 1, 2018, and must complete the registration by December 17, 2018.  Retailers may access a fillable PDF Temporary Registration Form via the link below.  The temporary registrations, which are free of charge, will expire on January 2, 2020.  Prior to the expiration of the temporary registrations, the Unit will provide information about future registration requirements.

Once the Temporary Certificate of Registration is approved, the Unit shall issue a certificate for each place of business where the entity engages in the sale of electronic smoking devices. 

Please note that the Electronic Smoking Device Retailer Registration requirement is separate and apart from the Retail Tobacco Permit.  If you sell cigarettes or tobacco products, you are required to obtain a Retail Tobacco Permit from the Department of Taxation, pursuant to Hawai‘i Revised Statutes (HRS) § 245-2.5.  Retailers selling both tobacco products and electronic smoking devices will need to apply separately for both the permit and the Temporary (or non-temporary) Certificate of Registration.  Please also note that if you sell e-liquids, even if you do not otherwise sell electronic smoking devices or tobacco products, you are still required to register with the Electronic Smoking Device Retailer Registration Unit.
